Terms of Service for Baby Generator

1. Introduction

Welcome to Baby Generator, owned and operated by Kawaii, Inc., an AI-powered image & text generation application. These Terms of Service ("ToS") are a legal contract between you, the user, and Baby Generator ("we", "us", or "our"), governing your use of the Baby Generator application and services.

2. Acceptance of Terms

By creating an account, downloading, installing, or using Baby Generator, you agree to be bound by these ToS. If you do not agree to all terms and conditions, do not use Baby Generator.

3. Eligibility

You must be at least 13 years of age to use Baby Generator. Users under 18 must have permission from a parent or legal guardian.

4. User Accounts

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. Providing false contact information of any kind may result in the termination of your account.

5. Use of the Service

Baby Generator allows you to generate images based on textual inputs and images you upload using AI technology. You agree to use Baby Generator only for lawful purposes and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of Baby Generator.

6. Content and Conduct

You are solely responsible for the text inputs and images you upload or use to generate images, and for any content you create, share, or display on or through Baby Generator. You must only upload photos and images that you own or have the right to use, and you must have the consent of any person depicted in them.

You must not use Baby Generator to create, share, or display:

Illegal or unlawful content.
Infringing content that violates intellectual property rights.
Content that is defamatory, obscene, pornographic, offensive, hateful, or promotes violence or harm.
Content that violates privacy or publicity rights.

Baby Generator reserves the right, but not the obligation, to review and remove or disable access to content that we determine, in our sole discretion, violates these ToS.

7. Processing of Your Photos, Prompts and Videos

To generate your results, the photos and prompts you submit are sent to third-party AI providers that act as service providers on our behalf. We currently use OpenAI (image generation, editing and content moderation), Replicate together with Alibaba Cloud (whose official HappyHorse video model powers Baby Video keepsakes), OpenRouter (short text generation) and Google Cloud (authentication, storage and hosting). This is described in detail in section 6 of our Privacy Policy.

We do not keep the photos you upload. Your uploaded parent and baby photos are processed transiently and are not stored on our servers. Generated results are deleted automatically 24 hours after they are created — save or share anything you want to keep before then, because we cannot recover a result once it has been deleted.

Model training. We do not use your photos, prompts or results to train AI models. Our providers state that content submitted through their APIs is not used to train their models, except where you separately and expressly consent. Providers may retain inputs and outputs briefly under their own policies — for example for abuse monitoring — which we do not control.

You confirm that you have the rights and permissions described in section 6 (Content and Conduct) above for every photo you upload, including the consent of any person depicted.

8. Intellectual Property Rights

The images generated by Baby Generator are derivative works created by AI. You are granted a limited, non-exclusive, non-transferable license to use images generated by Baby Generator for personal, non-commercial purposes.

9. License Grant to Baby Generator

By using the Services, you grant to Baby Generator, its successors, and assigns a perpetual, worldwide, non-exclusive, sublicensable, no-charge, royalty-free, irrevocable copyright license to use, copy, reproduce, process, adapt, modify, publish, transmit, prepare derivative works of, publicly display, publicly perform, sublicense, and/or distribute text prompts you input into the services, or any output produced by the service at your direction, including without limitation images, videos, text, and other content. The license granted to Baby Generator remains in effect even after termination of this Agreement by any party, for any reason.

10. Privacy Policy

Your use of Baby Generator is also governed by our Privacy Policy, which explains how we collect, use, and disclose information that pertains to your privacy.

11. Limitation of Liability

Baby Generator and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the service.

12. Changes to Terms

Baby Generator reserves the right to modify these ToS at any time. We will provide notice of any significant changes by posting the new ToS on the service.

13. Termination

Baby Generator may terminate or suspend your access to the service immediately, without prior notice or liability, for any reason, including breach of these ToS.

14. Governing Law

These ToS shall be governed by the laws of the jurisdiction in which Baby Generator is based, without regard to its conflict of law provisions.
